Information on how to enter the competition forms part of these terms and conditions of entry. Entry into the competition is deemed acceptance of these terms and conditions.
The competition is offered by Pronto Software Pty Ltd of 20 Lakeside Drive, East Burwood 3151, Victoria Australia ("Promoter").
The competition is open to Australian residents only.
To enter, Eligible Entrants must, during the competition period, visit the Registration Page and submit their contact details and survey questions.
Eligible Entrants are permitted one entry only.
The prize consists of a Navman iCN 520 mobile, pocket-sized satellite navigation unit with included windshield mounting bracket, 12 volt DC power adapter that connects to a vehicle cigarette lighter socket, carry case, USB cable and mains power adaptor. The prize has a recommended retail price of AU $999.00.
Should the prize remain unclaimed, an unclaimed prize draw will take place at 10:00am EDST on Thursday December 7th, 2006 at the Promoters office. The unclaimed prize winner will be notified by mail and their name published in the public notices section of the Herald-Sun newspaper on Monday December 11th, 2006.
The prize must be taken as offered and cannot be varied. Prize values are GST inclusive and are in Australian dollars and are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value.
The Promoter accepts no responsibility for late, lost or misdirected entries. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address in order to claim their prize.
The competition commences on Wednesday November 8th, 2006 at 8am EDST and concludes on Thursday November 30th, 2006 at 5pm EDST.
If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to state regulation.
The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding a prize.
Employees and their immediate families of Pronto Software Pty Ltd and/or their associate and affiliate companies, suppliers and resellers are not eligible to register for this competition.
The prize must be taken as stated and no compensation will be payable if the winner is unable to use the competition as stated. The competition is not transferable to another person or business (unless agreed to by the Promoter) or exchangeable for other goods and services and cannot be redeemed as cash.
Other discounts or offers cannot be applied in conjunction with the competition.
The Promoter and its related bodies corporate, officers, employees, contractors and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect or consequential loss) which is suffered or sustained in connection with this competition, the promotion of this competition or the use of the prize, except for any liability which cannot be excluded by law.
If for any reason the competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the competition.
If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this competition.
Entry details remain the property of the Promoter. Entrants consent to the promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete, inaudible or incomprehensible entries will be deemed invalid. No responsibility will be taken for lost, late or misdirected entries.
The result of the draw is final and no correspondence will be entered into.
The prize draw will take place at 10:00am (EDST) on Friday December 1st, 2006 at the Promoters office. The winner will be notified via email, their name will be posted on the Promoters web site and details will be published in the public notice pages of the Herald-Sun newspaper on Monday December 4th, 2006.
The Promoter may change or modify these Terms from time to time, with or without notice. Revised terms are applicable from the date posted.
